Sexual harassment in the workplace can occur between any two people, including co-workers, contractors, nonemployees, and supervisors.

Three conditions must be established to constitute a s*xual harassment claim:

1️⃣ The harassment must be severe enough to affect the terms of employment.

3️⃣ After being notified, management failed to take sufficient action and the s*xual harassment continued.

Under the federal Fair Labor Standards Act, employers are required to pay time-and-a-half for all hours worked over 40 hours per week.

Under this act, there are also strict guidelines for commissions.

When an employer does not pay for commission, the claims are subject to doubling and require the employer to cover the employee’s legal fees.

The Equal Employment Opportunity Commission (EEOC) sued Focus Plumbing, LLC on behalf of female employees who only spoke Spanish and were being s*xually harassed by co-workers and supervisors.

After one employee sent a complaint to the EEOC, the organization was able to sue Focus Plumbing.

The case was settled with Focus Plumbing paying $500,000 to the employees. The company will also be monitored by an independent company to ensure the harassment does not happen again and no retaliation occurs.

The Federal Fair Labor Standards Act (FLSA), combined with state and local laws, makes sure that workers' rights are being protected.

It states that if you work more than 40 hours in a week, you should get paid 1.5 times your usual rate for those extra hours. It also has rules about how bonuses and commissions should be paid, and how to correctly classify and pay employees.

Sometimes, employers might not be following these rules without even realizing it. For instance, they might not pay overtime to managers or those on a salary, or mistakenly classify employees as independent contractors.

In November 2022, Pivotal Home Solutions paid $175,000 in settlement after the Equal Employment Opportunity Commission (EEOC) sued them.

They had unfairly fired a temp worker for having PTSD and anxiety, even though her work performance was unaffected. The supervisor called it a "nervous breakdown" which led to her dismissal.

This is a reminder that under the Americans with Disabilities Act (ADA), it's against the law to discriminate against an employee due to a disability—real or perceived.
