Myth Busting Racism:

A common myth about racism is that it ended in the past with milestones like the Civil Rights Act. But the facts show racism persists:

Data shows Black Americans still face discrimination in housing, banking, health care, employment, education, and justice.
Voting restrictions disproportionately disenfranchise minority voters.
Studies reveal unconscious racial bias continues to impact people of color negatively.
Hate crimes and racist rallies reveal extremism is on the rise.
Racism has evolved but still impacts society today. Acknowledging modern discrimination is key to dismantling racism. Progress requires truth.

This month's curriculum is a toolkit to be used alongside Matt Nadel and Megan Plotka's documentary film, Liberation for Black Trans Women. TW: this film highlights the difficult topic of survival s*x work.

In the documentary, a group of Black trans women share their experience with and around the CANS law, Lousiana's Crime Against Nature Law by Solicitation — a law that specifically targets the lives of Black and POC women of color. They discuss how discrimination limits their means of existence and how survival s*x work is often mandatory to stay alive.

During a guided discussion, we ask you to consider what steps can be taken to create a more equitable society and how we can push back on discriminatory policies like the CANS law.

The 13th Amendment to the United States Constitution ratified in 1865, abolished slavery and involuntary servitude, except as a punishment for a crime. The specific wording of the exception clause is as follows:

"Neither slavery nor involuntary servitude, except as a punishment for the crime of which the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."

This exception clause has been a subject of much debate and criticism because it has been historically exploited to perpetuate involuntary labor practices, mainly through the convict leasing system and chain gangs during the Reconstruction and Jim Crow eras. Critics argue that this exception has contributed to the continuation of forms of coerced labor and contributed to the disproportionate incarceration rates of Black individuals and other marginalized communities.

This curriculum is the product of a convening of over 20 black-led base-building organizations that came together to discuss the implications of bail and bail reform on black communities across the country.

A subset of convening participants formed a working group that developed this curriculum. We understand bail as a limited, but necessary step, towards ending the mass criminalization and incarceration of our communities. Together we seek to ensure that communities most impacted by oppressive policing and incarceration are centred as experts in formulating alternatives to pretrial detention and incarceration.
