Migrant died 'after medicine taken away' at U.S.-Mexico border 07/23/2024

Our client Lianet Alvarez Osorio's mother Idania Osorio Dominguez tragically died while in Customs and Border Protection (CBP) custody. CBP never informed Ms. Alvarez Osario of her death, as is their protocol. After frantically searching for information about her mother's whereabouts after she stopped hearing from her, she found out the devastating news through a CBP press release days later.

Earlier this year we filed a FOIA lawsuit seeking information surrounding the death of Ms. Osario Dominguez. Because of our lawsuit, we have since found out her medication was taken away despite CBP knowing she had hypertension. "Five hours after she went into their [CBP] custody, she complained about chest pains, and then she collapsed and died. We still don't have a death certificate yet."

California heat has immigration activists bracing for a humanitarian crisis 07/22/2024

According to the United Nations, the U.S./Mexico border is the “deadliest land route for migrants in the world.” With record-breaking temperatures here in California and nauseating heat, it’s about to become even deadlier and Biden’s recent asylum restrictions will only exacerbate this situation as people grow increasingly desperate. As we continue our water drops in the Otay Mountain Wilderness we’re seeing several cases of intense exhaustion and dehydration amongst asylum seekers, including women and young children. CBP reports a steady rise in migrant deaths, affirming that “the overwhelming majority of deaths on the border are because of environmental exposure/ heat.” We will continue to deliver life-saving humanitarian aid to migrants who are crossing to seek asylum for as long as it takes and are grateful to organizations like Borderlands Relief Collective who work alongside us.

Volunteers leave bottled water for migrants in deadly smuggling corridor 07/19/2024

The Sunland Park-Santa Teresa migrant corridor in the New Mexico desert is “one of the deadliest in America.” Since October, 119 people have died trying to cross through the corridor and, as temperatures soar above 110 F/ 43 C, that number will only rise. In response, selfless volunteers and border organizations have been providing precious drinking water along migrant routes for years. To all those criminalizing humanitarian work along the border, this is a reminder that this has “absolutely nothing to do with politics,” rather it represents honoring the fundamental rights of another human who “has the same rights, same dreams and deserves a chance to live” as anyone else.

“Whatever our position on immigration, I don’t think anybody can agree that the death of people is a fitting response, a solution.” We couldn’t agree more.

The dangers of CBP One, the app to request asylum at the US-Mexico border: Extortion, kidnappings and months-long waits 07/18/2024

Not only does the CBP One mobile app pose significant barriers to folks seeking asylum, including month-long wait times of up to 9 months for appointments, it unequivocally puts asylum seekers’ lives at risk especially those with disabilities who can’t even access the app. We’ve been sounding the alarm on the app’s glaring inefficiencies and glitches since its inception. Our executive director Erika Pinheiro spoke to El País about our litigation to stop its use and why it endangers the lives of people seeking protection in the U.S.

As Human Rights Watch has reported, migrants remaining in Mexico for their future CBP One appointments often face: “forced relocation to southern Mexico by Mexican officials; a lack of access to basic services like health care, potable water, and shelter; violence at the hands of criminal groups as well as Mexican immigration authorities, National Guard soldiers, and police; and the possibility of summary deportation.” Individuals without access to a smartphone, strong wifi, or fluency in one of the languages of the CBP One app (English, Spanish, or Haitian Creole) are further obstructed from seeking asylum. The right to save one’s life shouldn’t hinge on a glitchy smartphone app.

Personalized thank-you drawings are always great, but these drawings right here are the best. *Aleida and *Luz, are two unaccompanied child asylum seekers from México that we accompanied in Tijuana. Much like little girls throughout the world, they love to draw, they like unicorns, and they love the dogs at the home in which they once lived in with their parents, before life became bad, scary, and too dangerous to stay.

Referred to our Border Rights Project, the girls were nervous about what would happen to them now. They had an aunt living in the United States, but they were not sure how to get to her. They also had a deep distrust of adults because of the things that adults had done to their family, and were continuing to try to do.

But they were instantly reassured by Abogada Kathy, who coordinates AOL’s services for unaccompanied children at the border. Kathy shared a video of her dogs, bonding with the girls over their love of animals, while Aleida and Luz marveled at Kathy’s many arm and hand tattoos, and planned for a future that would include a dog of their very own.

Weeks after the girls were able to reunite with their aunt in the United States, the girls’ aunt sent Kathy these thank-you card drawings. It’s funny what kids remember, and how they interpret the world around them, because it’s unlikely Kathy and the CBP officer were close enough to be holding hands, or that the officer was smiling. 😄

Since reuniting with their aunt, Aleida and Luz celebrated Luz’s 6th birthday. They saw snow for the first time, and they’re talking about adopting a dog. A new life is beginning, and they’re replacing the bad memories with new memories of happier days, the kind of days all little girls deserve, regardless of what side of the border they were born.

In honor of yesterday’s Pride march in Tijuana, we stand united in denouncing the violence and discrimination LGBTQ+ people endure. These acts are traumatizing and dehumanizing and threaten their very lives. Mexico has the second-highest number of known homicides against transgender people worldwide, and there have been at least 513 targeted killings of LGBTQ+ people in Mexico from 2018-2024. Thousand more have died of AIDS, exacerbated by the government's failure to ensure adequate healthcare and widespread access to life-saving medications.

It’s for that very reason, Al Otro Lado and our partners Lacasitadeut Tijuana chose to dress in black to mourn and honor our lost LGBTQ+ siblings and bring attention to the grave injustices and constant danger LGBTQ+ people face everyday.

LGBTQ+ people have existed across cultures for thousands of years, however over the last several years we have seen a rise in hateful rhetoric, especially against Trans people, being spewed by elected officials and religious “leaders” in the US. LGBTQ+ people are still being killed in countries all around the world, including the US. That this kind of discourse and endemic violence exists shows us that we still have so much farther to go in order to achieve a world where LGBTQ+ people can live authentically and without fear and today was a reminder of that.

In May of 2018, Josue* faced every parent's worst nightmare: his 14-year-old daughter, Alegra*, was forcibly taken from him under Trump’s horrific policy that saw the separation of over 5,000 children from their parents. After several months of anguish, Josue and his daughter Alegra were reunited in the U.S., but the rest of his family, Josue’s wife, two young sons and his daughter, all remained in danger in their home country.

For years, the family endured this agonizing separation. However, after nearly a year of relentlessly advocating for the reunification of the entire family, Al Otro Lado’s Family Reunification Program was able to get the government to grant humanitarian parole, so that after five long years of separation, the family could reunite in the United States. Since that time, their family has settled into their new community, while working toward healing and securing justice.

Beaming with pride, Josue recently shared with our team that his son, Eliseo*, would be receiving an award for academic excellence during the 2023-2024 school year. Despite the immense challenges of adapting to a new school, country, and language, Eliseo* and his siblings are thriving. Josue expressed profound gratitude to Al Otro Lado and its supporters, calling the reunification of his family the greatest gift he had ever received.

Well Josue, you too gave us a great gift; the privilege of witnessing our clients thrive, not just surviving, after facing so much unimaginable hardship. It’s moments like these that light the way when it all goes seemingly dark, and give us strength to keep fighting for the kind of world that all human beings in migration deserve.
