Well-intentioned people can disagree. But skilled, experienced mediators can help both sides find common ground and start on the road to reaching a mutually agreeable resolution.
Just as we don’t always succeed on our first attempt, the same applies to mediations. Certainly, not every dispute is resolved in the first mediation, but with commitment, attention to detail and follow up, we can almost always reach an equitable resolution.

The pandemic has been tragic and stressful, but it’s also been something of a learning experience. Take a moment and read my “Lessons from the Pandemic” blog

Life Lessons From The COVID-19 Pandemic - Kim L. Kirn I’ve always tried to learn from all of life’s experiences, the good and the bad. Here are four life lessons I’ve learned from the pandemic.
Ever since I was a young girl I’ve loved birthdays, especially my own. I still do, but now every year on my birthday I take time to think about all of the gifts I have in my life; my family, my friends, wonderful colleagues and clients, my health, and of course, Roscoe!
The pandemic has created both temporary and lasting change. I firmly believe virtual mediation (among other changes) is here to stay in some form. Learn more about virtual mediation by watching my new video.

Litigation demands endless amounts of time and effort, hefty legal expenses and months or years of conflict, and comes with a large dose of stress. But there are alternatives! Don’t fall into the litigation trap!

Monday Mediation
Trusting that all will be okay and working toward a solution that is amenable to everyone.... this is how mediation works.
Friday Funny: When it gets right down to it, even in the midst of the most contentious situations, we all just want to be heard and get along, right?
What is in a name?
KIM KERN, no wait its spelled Curran or is it KIRN?
What is in a name? In the words of Shakespeare, "A rose by any other name would smell as sweet." Does a name really matter? Juliet tells Romeo it does not matter that he carries the name "Montague” and his family is her family's rival. Much like Juliet, I do not get wrapped up in names. Perhaps it is because most women take their husband’s name at marriage (I kept my maiden name even thought my husband’s name is probably easier to spell!). Maybe it is because as a 21st century American we leap at the chance to assume pseudonyms on Instagram and Tik Tok.
My name has been misspelled and mis-pronounced my whole life and it really does not matter to me. I am just happy to be part of the conversation. Don’t sweat the name. Do your best to pronounce unusual names. Ask for help. Let the person know it is hard for you; maybe they can give you a tip for pronunciation.
In my mediations, I make an effort to spell and pronounce everyone’s name correctly. But if I or others make a mistake, don’t sweat it. You are still just as sweet.

Friday Funny: “So two lawyers, a plaintiff and a defendant walk into a mediation …"
Starting a mediation with a settlement agreement can help identify problems at the outset of the negotiations, which then can set the stage for a successful resolution.

Mediation attempts to reduce conflict and come to an amicable agreement through meaningful dialogue between disputing parties. This process is far less stressful and hostile than litigation.
Love this crazy cartoon. Maybe as things return to normal, the book store will re-organize again!
One of the biggest factors for succeeding in mediation is listening to better understand where the opposing party is coming from.

This is the day to think about our fathers: The funny ones, the quiet ones, the serious and unwavering “behind-the-scenes” supporters and advocates who have done so much for so many. This is a great day to stop to think about them and their contributions to our lives.
I'd love to give a special shoutout to a couple very important dads in my life: My husband David George and my father Nelson Kirn!
Happy Juneteenth, America. It is wonderful that this important day in history is finally getting the recognition it deserves.
Freezing screens, unintended muted microphones, attendees lurking behind blank screens, people dropping off. No Zoom call would be complete without at least a couple of “Are you there?” moments. Zoom calls are truly modern-day seances, in which we all await that otherworldly voice from somewhere in the ether... Can you hear me?
Arbitration gets a bad rap: Many think arbitrators simply rule somewhere in the middle to avoid making either party upset.
However, that is simply not the case…
The Myth Of 'Splitting the Baby' In Arbitration - Kim L. Kirn I am an advocate of arbitration, and this is why: giving the parties a faster, cheaper, and certain decision has great value.
