We at Philippine Misereor Partnership, Inc. (PMPI), express our wholehearted endorsement and steadfast support for the Marinduque Environment Code, for its vision to protect the island’s ecosystem by protecting its rights and most particularly its firm stance against mining activities.

PMPI welcomes the integration of the recognition of the Rights of Nature perspective into the proposed Marinduque Environment Code of 2023. This represents a significant stride towards safeguarding the island's ecosystems from destructive activities like mining.

The tragic event in 1996, where the Boac River suffered irreversible damage due to the neglect of Marcopper Mining Corporation, serves as a poignant reminder of the devastating consequences of irresponsible mining practices. The lasting impacts of Marcopper Mining in the people’s lives, encompassing environmental degradation, the loss of aquatic life, illnesses, and the tragic loss of innocent lives, underscore the urgent need to prioritize the preservation of Marinduque's rich natural resources.

Recognizing the Rights of nature on the island demands that Marinduque’s designation as a mining reserve should be rescinded. The island be recognized instead as a mining-free zone and all mining permit applications should be stopped.

We also commend the recognition of the Rights of Nature in the proposed Marinduque Environment Code of 2023, a landmark step towards the sustainable use of natural resources for the benefit of future generations of Marinduqueños. The Rights of Nature bill is crucial in providing additional protection to Marinduque’s rich ecosystems.

We also implore the national government to actively contribute to local efforts to restore and protect their environment with the passage of this code ensuring the restoration of nature and the safety of the people on this island and recognize it as a mining-free zone.

We trust that the Sangguniang Bayan will pass the bill unanimously. If passed, it will also serve as a crucial step in ensuring not only the protection of its ecosystem but also sustainable development for the province. It can spawn an adoption of a way of life that considers the mutually beneficial relationship of the people in the community with nature. A healthy ecosystem means healthy people, enjoying all the benefits and rights together can lead to a more sustainable future.

According to a data gathered and new report by Save the Children Born Into The Climate Crisis –children born in 2020 will face 7% more wildfires, 26% more crop failures, 31% more droughts, 30% more river floods, and 65% more heatwaves than if global warming were stopped at 1.5°C.

Albert Muyot, Chief Executive Officer of Save the Children Philippines shared “We are raising the Red Alert on climate crisis. Without a sustainable and healthy future, children’s right to survive is put at risk. The government should ensure effective implementation of environment policies and scale up social protection systems to mitigate the increasing impacts of climate shocks on children and their families.”

Recognizing and implementing the Rights of Nature Ph bill can play a crucial role in achieving climate justice and addressing the climate crisis by giving ecosystem protection. This can prevent overexploitation, deforestation, and other destructive activities that contribute to climate change.

Rights of Nature: Protect Our Common Home

“Rights of Nature” is a concept, at the heart of which lies key is addressing our dysfunctional economic system and the legal, social and political and modern cultural frameworks that are destroying people and planet. In hindsight it is the recognition and honoring that the environment has rights just as human beings.

The Rights of Nature framework came from the experience that after decades of environmental protection laws (some of which have achieved some notable successes), our modern political and legal systems have failed to prevent the increasingly grave threats of climate change, ecosystem degradation, and the growing displacement of humans and other species.

“Critically, a Rights of Nature framework also provides a path through which people can re-learn respect for Mother Earth, as Indigenous peoples of the world have been demonstrating for thousands of years. The framework should be“we are not just protecting nature, we are nature - a recognition of profound significance given that it is the belief that we are separate from the Earth that resides at the root of and furthers a destructive relationship to the natural world.”
