Delta 8 THC product raising questions about legality, local prosecutions 10/08/2021

Yes, Brazos County prosecutes possession of "delta 8" THC and you may be arrested for buying something you thought was completely legal in a local store! Local news media reported this week that many have been surprised, since many local stores sell it. This firm fights for clients charged with Delta 8 possession. In one case, a client was arrested for a First Degree Felony for possessing over 400 grams of THC because he had packaged samples branded as "delta 8" products he was delivering to local stores. Texas imposes new "super fines" upon a conviction of DWI:

Be aware that if you are convicted of DWI and sentenced to jail for even a short time, the State of Texas imposes a mandatory fine in addition to the statutory (and negotiable) fines (up to $2,000 for a first DWI or up to $4,000 for a 2nd DWI or if the BAC is 0.15 or more). These fines are set by the State and a prosecutor or judge cannot negotiate or lower them. They are:

$3,000: 1st DWI
$4,500: 2nd DWI if committed within 36 months of the first DWI
$6,000: if the BAC is 0.15 or more, whether it is a first or subsequent DWI

Judges are allowed to eliminate them only if you can prove you are "indigent" - documentation from tax returns that show you are at the "poverty" level or that you receive financial assistance from the government.

Brazos County has suspended jury trials for the month of February for Covid-19 concerns. High county infection rates endanger citizens attending jury duty and cause problems getting a fair trial for clients when many potential jurors and witnesses may not be able to attend. Brazos County courts, however, are still conducting all other types of hearings and trials. Be careful and stay healthy!

Brazos County and the cities of Bryan and College Station have enacted "shelter-in-place" orders beginning today, March 24th at 9 pm, through April 7th at midnight. If you are not conducting essential activities, healthcare, essential infrastructure, government or business functions, or essential travel, you could be fined up to $1,000 and/or jailed up to 180 days. These are very broad categories and we are still able to do a lot, as long we use common sense.

Essential business and activities does include legal services - so we are still here and able to help. Don't hesitate to call. Don't spend New Year's Day in Jail because you tried to drive home after the party! Police will be out looking for anyone they think are driving drunk and you likely won't be able to refuse the alcohol test - they will get a warrant from a judge for your blood. If they get a warrant, it counts as a "refusal," and will result in driver's license suspension for 180 days. Blood results can show your blood alcohol content and be used against you in court - 0.08 or more can be up to 6 months in jail, but the punishment doubles if your BAC is 0.15 or more with up to one year in jail. Have fun tonight, but be safe - get a friend, Uber, or cab to take you home. But, if you are accused of DWI, I will fight for you. Call within 15 days to save your license!

Don't just pay a traffic ticket - adding points to your driving record and driving up insurance costs! Worse yet, tickets for no insurance or driving while your license was suspended will cost hundreds of dollars in surcharges or another suspension. Fight the ticket and keep it off your record.

The Brazos County Juvenile Detention facility is getting bigger. The $17.3 million expansion will nearly double its size. That means that more kids may spend their time there, wearing orange jumpsuits and away from their families, than in school, playing with friends, and at home. This is not a fun place or just another school - their hands and feet are shackled when in court, they live behind iron doors, and are monitored by detention guards 24/7. It is not a place we want our kids to be. Yet, when a kid, even as young as 10, is accused of a criminal offense, that is where they will first go - until released by a judge after a hearing. Kids cannot bond out - they must stay there until a judge is persuaded to release them.

More than adults, kids need an attorney watching out for them from that very first court hearing only a day or two after their arrest. One of the most radical changes made by Texas in 2017 was the ability to seal your misdemeanor criminal record, even if you have a conviction. In the past, only if you had deferred adjudication were you allowed to file a non-disclosure petition which would result in keeping the public from seeing your mistake.

Now, most misdemeanor convictions with probation or even jail time may be sealed – including DWIs! There are some exceptions, such as sexual or family violence offenses. Texting while driving ban becomes law in Texas 07/11/2017

Beginning September 1st, you could get a ticket if you are texting and driving anywhere in Texas. The exact language is "read, write, or send an electronic message" - so you can't even check your texts while driving. But the police officer must see you do it to write you a ticket (they are not allowed to grab your phone and look at it or seize it as evidence just for this offense).
The ticket could cost you from $25 to $99 (or, for repeat offenders, from $100-$200) and does not add any points to your license. Don't worry - you may still use your GPS, your favorite music app, or read an Amber alert or other emergency notification. And you may still talk on your phone without a hand-free device - unless you're under 18. Shannon Flanigan brings over 20 years of experience in criminal law to your defense when you have been accused of a crime. With practicing criminal law in the courtroom as his passion, he graduated from Baylor Law School in 1996 with a concentration in Criminal Law. He began as a felony prosecutor in Fort Stockton, trying cases in five counties in West Texas, from drug possession to capital murder. That experience also took him to the courts of appeals in El Paso and San Antonio as well as the highest criminal court in Texas, the Court of Criminal Appeals in Austin. In 2003, he moved to Bryan to the Brazos County District Attorney’s Office, where he tried juvenile and adult cases until 2007. That year, he opened this firm and began helping those charged with criminal offenses. Since then, he has had the privilege of representing hundreds of clients throughout the Brazos Valley in cases ranging from traffic tickets and DWIs to assaults and capital murder.
