There are many situations in which a termination can be unlawful, but the place you should always start is that in New York State, an employee can be fired for any reason or even for no reason. I know, this can seem like a very scary prospect. Keep in mind though, there are exceptions to this “employment at will” rule. So when is it legal to be fired in NY?

A: An employer is not required by law to pay severance if you’ve been laid off. That being said, many do in order to avoid a potential lawsuit, and the legal expenses associated with it. It’s also good PR for an employer to pay severance. When other employees hear about severance packages, it’s good for morale. A notable litigation decision I am proud of:

Mt. Vernon City School District vs. John Doe (name omitted for confidentiality purposes); represented high school guidance counselor charged with making improper grade changes for students on approximately eight occasions. The District used its IT expert to establish the grade changes came from the counselor’s computer. Also charged with failing to properly schedule students, including seniors, resulting in missed mandatory courses delaying or preventing graduation. The State Education Department Hearing Officer found that the counselor had made no grade changes, accepting his version of events wherein he testified that he had no motive to change grades since it does not affect his performance reviews. The Hearing Officer also faulted the district for not providing proper training to the counselor in the area of student scheduling, course prerequisites and graduation requirements.

Is the NYC employment law targeting the use of AI in hiring a good thing? Or....?

I can see how this new(ish) tool can be helpful and harmful to people both, depending on how good the technology is and how vulnerable it is to human manipulation. A company that uses AI of this type can attempt to manipulate it to exclude certain classes of applicants from consideration, which is what the law is trying to prevent. On the other hand, if used properly, the technology can be used effectively and without the human bias we see in some employment decisions.
