ENDING ‘VISA HOPPING’ IN THE MIGRATION SYSTEM
A key commitment in the Migration Strategy, released last year, was to restrict ‘visa hopping’ - ending the loopholes that allow students and other temporary visa holders to continuously extend their stay in Australia, in some cases indefinitely.
As noted in the Migration Strategy, the numbers of international students staying in Australia on a second, or subsequent student visa has grown by over 30 per cent to more than 150,000 in 2022-23.
Peter McDonald, a renowned Australian demographer, recently said that severely curtailing visa hopping by accepting fewer visa applications from people already in the country would better manage population growth than cuts to the permanent migration intake.
The Government has already taken action to address this, by using no further stay conditions on visitor visas and through the Genuine Student requirement implemented in March which has stopped thousands of students from hopping from student visa to student visa unless there is credible course progression. This complements more than a dozen other policies already implemented that are helping restore integrity in the international student system, such as ending unrestricted work rights and the former Government’s COVID visa.
On 1 July, the Albanese Government is taking this a step further.
Firstly, Visitor Visa holders will not be able to apply for Student Visas onshore. The visitor to student pathway has become increasingly prevalent, with over 36,000 applications since 1 July 2023 to the end of May 2024.
This measure closes a pathway that has been used to attempt to subvert the Government’s strengthened offshore student visa integrity measures.

📢Exciting News for WORKING HOLIDAY MAKERS in Australia

The Minister for Immigration, Citizenship, and Multicultural Affairs has announced significant changes to the Working Holiday Maker (Subclass 417 and 462) visa program, effective from 1 January 2024!

🟣 Extended Work Rights:
In some circumstances, Working Holiday Makers can now work with the same employer for more than six months without the need for prior permission from the Department of Home Affairs.

🟣Temporary Exemption:
Working Holiday Makers are temporarily exempt from Condition 8547, allowing extended work periods with an employer.

🟣Eligible Work Scenarios:
From 1 January 2024, extended work rights apply for various scenarios, including when an employer is located in more than one location, the work is related to plant and animal cultivation, specific industries, natural disaster recovery, critical sectors like health and tourism, and more.

🟣Application Process:
For situations not covered above, Working Holiday Makers must request permission for extended work rights (you can find the form in the link below). The application process opens on 22 December 2023, and requests should be submitted at least two weeks before the six-month work period expires.

🟣Documentation Required:
Applicants may need to provide details of limited circumstances and supporting documentation from employers outlining exceptional circumstances.

✨ This is an overall positive Impact for businesses and Working Holiday Makers, offering an option to stay and work in Australia for an extended period without changing employers.

Breaking News! Permanent resident pathway for all TSS visa holders from the
25 November 2023.

We have been anticipating this announcement for the past 7 months or so with a particular focus on a streamlined pathway to PR for 482 visa holders after only 2 years.
We have finally received further information about these exciting changes to the immigration system, aiming to simplify the route to permanent residency for Temporary Skill Shortage (TSS) visa holders, particularly those within the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS) (subclass 186) visas. These changes, set to take effect from November 25, 2023, will apply to new Subclass 482 visa applications submitted on or after this date and new Subclass 186 and 187 nomination applications that are still pending as of November 25, 2023. In this article, we will delve into these transformations and examine their implications for both Australian employers and skilled workers.
What is actually changing from the 25th November?
Under the existing system, short-term stream TSS visa holders face restrictions on the number of applications they can lodge within Australia, causing inconveniences for both employers and employees. The upcoming changes are intended to eliminate these constraints, allowing short-term stream TSS visa holders to submit all their applications in Australia. This represents a significant improvement, reducing disruptions and offering a more predictable path to permanent residency for these workers.
The current system also imposes several restrictions on TRT stream nominations. Currently, the nominated occupation must align with skilled occupation lists, and Subclass 482 visa holders are required to have worked in the nominated position with their sponsoring employer for at least three years before applying for permanent residency. With the new legislation, the nominated occupation will no longer be assessed against a skilled occupation list, and the period to apply for permanent residency through the TRT stream will be reduced from three to two years.
Summary of the Changes For Subclass 482 Visa Applications:
1. All short-term stream TSS visa applications can now be submitted in Australia.
2. Limits on the number of short-term stream TSS applications that visa holders can lodge in Australia will be eliminated.
3. Short-term stream TSS visa holders with visas expiring before November 25, 2023, must travel outside Australia to lodge a third short-term stream TSS application.
For Subclass 186 (TRT) Nomination Applications:
1. Employers will now be able to nominate holders of all TSS visa streams, including Short-term and Labour Agreement streams, for permanent residency.
2. Visa applicants must have held their Subclass 482 (or Subclass 457) visa(s) for 2 out of the last three years before nomination.
3. Visa applicants will be required to have worked in a position with their sponsoring employer for 2 out of the last three years before nomination.
4. Nominated occupations will no longer be assessed against a skilled occupation list. However, the occupation will still need to be listed in the Australian and New Zealand Standard Classification of Occupations (ANZSCO).
For Subclass 186 (TRT) Visa Applications:
1. Modifying age exemptions for regional medical practitioner candidates and high-earning individuals aged 45 and above, facilitating a streamlined two-year pathway.
2. Phasing out age exemptions related to COVID-19, which will no longer be applicable due to the implementation of the two-year pathway.
The forthcoming changes by the Australian Government to the TSS and TRT visa streams represent a significant stride towards providing a more streamlined and accessible route to permanent residency for skilled workers. These changes, commencing on November 25, 2023, are aimed at increasing certainty for employers and TSS visa holders, making Australia an even more appealing destination for skilled professionals looking to establish a long-term future in the country.

The New Aged Care Industry Labour Agreement presents an exciting opportunity for Migrants who are considering a career in the Care/ Support worker industry, as this agreement may be the ticket to fast track your pathway to Permanent Residency.
The key visa application requirements are:

🟣Have an Employer/Sponsor who is approved under the Labour Agreement

Victoria's 2023-24 Skilled visa nomination program is now open!

The reopening of the Victorian State Nomination Program for FYE 2024 is an excellent chance for individuals and families seeking to gain permanent residency in Australia.

1️⃣Why Consider Victorian State Nomination?
Receiving a nomination from the Victorian state government can significantly boost your chances of obtaining an Australian visa and, ultimately, permanent residency. Victoria is known for its strong
job market, high quality of life, and diverse cultural scene, making it an ideal destination for newcomers.

The Victorian program also offers pathways for those interested in settling in regional areas. The subclass 491 visa allows you to live and work in regional Victoria and has extended some regional
zones to outer suburbs of Melbourne.

2️⃣Skilled Nominated visa (subclass 190)
There are no changes to the subclass 190 visa nomination program.
If you submitted a subclass 190 Registration of Interest in 2022-23 and were not selected, you do not need to submit a new ROI unless the information provided has changed. In addition to your EOI,
please check your partner points and annual salary responses in your existing ROI and confirm they are correct. If they are not correct, please withdraw the existing ROI and submit a new one

3️⃣Skilled Work Regional (Provisional) visa (subclass 491) changes
To be eligible to apply for Skilled Work Regional (Provisional) visa (subclass 491) nomination in the 2023-24 program, onshore applicants must be living and working in regional Victoria at the time of nomination. Some outer suburbs of Melbourne are included in the regional zones.

As a result of this change, if you submitted a subclass 491 ROI in 2022-23 and were not selected, you will need to submit a new ROI if you are still eligible.

4️⃣Selection rounds
A Registration of Interest is not an application for Victorian visa nomination. The program is very competitive and there is no set timeframe for when you may be selected.
Your ROI will remain in our system for selection until it is withdrawn or selected. The program will close in early 2024 at a date to be confirmed.
